Delhi High Court permanently bans fraudulent websites from illegally streaming shows and movies aired on Disney Hotstar
The Delhi High Court has permanently blocked 50 fraudulent websites illegally streaming various TV shows, TV series and movies aired on OTT platform Disney+ Hotstar.
Justice C Hari Shankar The prima facie exclusive right to stream or telecast the content contained in 26 shows and movies is deemed to belong to the platform and not to any other platform.
The court was hearing a case filed by Star India Private Limited and Disney Plus Hotstar against fraudulent websites alleging piracy of copyrighted content.
The 26 shows and movies are Yeh Rishta Kya Kehlaata Hai, Ghum Hai Kisi Ke Pyaar Meiin, Anupamaa, Yeh Hai Chahatein, Imlie, Saath Nibhaana Saathiya 2, Aapki Nazron Ne Samjha, Pandya Store, Mehndi Hai Rachne Waali, Zindagi Mere Ghar Aana , Yeh Rishtey Hain Pyaar Ke, Ek Hazaroon Mein Meri Behna Hai, Lakshmi Ghar Aayi, Mann Ki Awaaz Pratigya 2, RadhaKrishn – Punar Milan, City of Dreams (2 Seasons), Grahan, Novell Story, Ok Computer, 1232 Kms, Live Broadcast, Triple, Hundred, Special Ops, Lion’s Roar, 1962: War in the Hills.
The court passed a preliminary injunction against fraudulent websites in August 2021. None of the defendants in the lawsuit were represented through an attorney.
In deciding the case, Judge Shankar ruled that the defendants, a fraudulent entity whose only business is the unauthorized broadcasting of television shows, movies, and web series whose copyrights are held by others, should not be broadcast. He said it was a “natural” choice. Appear in court.
“This is not a unique phenomenon. In several matters where such malicious websites have surfaced, this court has observed that those websites do not appear to contest the lawsuit. “Their general philosophy appears to be to make hay while the sun shines,” the court said.
Advocates Angad S. Makkar and Yatinder Garg appeared for the petitioner.
Advocates Apoorv Kurup, Kirtedaditya and Shivansh appeared for the accused.
